Citizen Contribution: Se Eekhout [1995] ZAConAsmRes 847 (16 February 1995)

Mrs S E Eekhout

I would like the following ideas to be taken into consideration when the
constitution is finally drawn up:

  1. . Workers should have the right to strike only once every twelve months and then for a limited period (possibly 5 working days) only.

This is to curtail wildcat strikes and the blackmail of employers through strike action. The economy of the country depends on an able and willing work force, not one making outrageous demands all the time.

  1. All students at institutions of learning should have the right to study without disruption by other pupils, students or staff, both academic and administrative.

I worked for the Department of Education and Training for 221/2 years and noted the following: We always had problems in March and September when first and second semester fees, respectively, were due and again in May and November when examinations had to be written. Students were intimidated to join in even when they just wanted to study peacefully.

  1. A person should have the right to be protected from the wilful damage to or destruction of state, provincial, community or private property during strike action and unrest.

It is so easy to damage or destroy what is not one's own. Repairing schools and institutions wilfully damaged by students and workers costs millions of rands which could be better spent on providing new classrooms, books, equipment and bursaries for needy students. I feel very strongly about the attitude that "If it is not available to everyone, no one will have it" which seems to prevail at the moment.

  1. It is the right of every person to be educated to become a useful member of society.

This does not mean that everyone will receive the same education, but that at the level he/she is able to reach, he/she will be a productive member of society.

  1. The proposed freedom of sexual orientation worries me if it applies to paedophiles as well. I sincerely hope it does not.
