DIRECTIVE FOR TRIAL INTERLOCUTORY COURT BEFORE MOGAGABE AJ
17TH TO 21ST April 2023
1. Kindly take note that matters will be dealt with in open court commencing at 10:00 at Court 6G.
2. Postponements, removals will be called first, thereafter matters will be called in order of seniority of counsel.
3. Legal practitioners need not introduce themselves in chambers, they can just stand up in court and introduce themselves.
4. Legal representatives should ensure that all relevant documents are uploaded to CaseLines including the practice note, notice of set down and the draft order which must also be emailed to NMasonto@judiciary.org.za (in Word format) two court days prior to the hearing of the matter.
5. The draft order reflecting the Judge’s surname, the relevant date and the correct case particulars should be uploaded as per the timeline described in paragraph 4 above.
6. Draft orders should contain a disclaimer and the name and details of Counsel/Practitioner and those of the instructing attorney.
7. Legal practitioners are requested to bring one hard copy of the draft order to hand up to Court.
8. If there is non-compliance with the practice directive, the matter will be struck from the roll, unless good cause is shown for non-compliance.
9. Removals and postponements should be communicated by e-mail to Mr. Masonto at NMasonto@judiciary.org.za.
10. All granted orders will be electronically endorsed on CaseLines and uploaded to CaseLines by Mr. Masonto.
