TO ALL LEGAL PRACTIONERS
UNOPPOSED MOTION ROLL: COURT DIRECTIVE FOR MATTERS BEFORE THE HONOURABLE JUSTICE TRUMPIE AJ: 12 & 14 APRIL 2023
1 Kindly be advised that the unopposed motion court roll for dates 12 & 14 April 2023 will be in OPEN COURT starting at 10:00. Counsel will be given an opportunity to introduce themselves, should they so wish to the Judge outside Court prior to the proceedings.
2 In order for the Court to consider a matter, parties should ensure that all the necessary documents are filed and to be uploaded onto Caselines.
3 A Practice Note, in terms of the Judge President’s latest Practice Directives, should be filed, and uploaded on time on Caselines. The said Practice Note should deal comprehensively with the issues to be decided upon in the matter, (i.e., previous postponements & reasons, personal service, relevant legal requirements for relief sought as well as identifying and disclosing, if any, of problems with said application).
4. A Draft Order should be filed and uploaded in both Word and Pdf Format on time onto
Caselines. The said Draft Order should include the name of Counsel/Legal Practioner and that of the instructing attorney appearing at the end of the said order. Further kindly ensure that the order complies with the Practice Directive, i.e., the Judge’s name, date, court room, etc. including the below disclaimer:
"This Order is made an Order of Court by the Judge whose name is reflected herein, duly stamped by the Registrar of the Court and is submitted electronically to the Parties/their legal representatives by email. This Order is further uploaded to the electronic file of this matter on Case Lines by the Judge or his/her secretary. The date of this Order is deemed to be 12/14 April 2023. (Insert correct date)"
5 One hard copy of the Draft Order is to be handed up on the day of the hearing.
6 Kindly take notice that the relevant documents should be uploaded onto Caselines as follows:
6.1 For matters of 12 April 2023, before 06 April 2023 at 14:00.
6.2 For matters of 14 April 2023, before 12 April 2023 at 12:00.
7 Failure to file a comprehensive Practice Note as well as a Draft Order will result in the matter being removed from the roll. No practice note and/or draft order will be accepted after the abovementioned due date and time.
8 No further documents are to be uploaded after the cut-off time indicated in the Practice Manual as read with the Practice Directive of this Court unless with the express permission of the Honourable Judge. Non-Compliance will result in the matter being removed from the roll due to papers not being in order.
9. Counsel/Legal Practitioners involved in other matters in other Unopposed Motion Courts, need to notify the Judge’s secretary timeously to ensure their matters not to be removed from the Court roll.
