DIRECTIVE

URGENT APPLICATIONS BEFORE HOLLAND-MUTER AJ 20-24 MARCH 2023

 

1.            Kindly see below roll of Urgent Applications with allocations of matters to be dealt with by Acting Judge Holland-Muter.

 

2.           Kindly take note that all matters allocated for hearing on 20 and 21 March 2023 will be heard virtually via Microsoft Teams (the link to the virtual proceedings will be sent in due course). Matters allocated for hearing from 22 to 24 March 2023 will be heard in open court 4C.

 

3.         In all matters (opposed and unopposed), a Practice Note as well as Heads of argument must also be served and filed by all parties concerned. The Practice Note must indicate at least the following:

 

3.1           particulars and contact details of the legal practitioners;

 

3.2          nature of relief sought / the main issues for consideration;

 

3.3         a brief summary of the factual as well as legal issues involved;

 

3.4         a clear indication of which portions are to be read and which not;

 

3.7         a brief summary of urgency or absence thereof;

 

3.8       whether or not there was service by the sheriff; and

 

3.9       estimated duration.

 

4.          Parties must ensure that they create a profile for their matter on both court online as well as Caselines and upload the necessary bundle of documents thereto. For assistance with court online parties must contact the court online call centre on 010-493 2600.

 

5.        Parties should ensure that Draft Court Order sought is uploaded onto Caselines by the day of the hearing. The Draft Court Order should set out the date of hearing, Judge’s name (i.e. Acting Judge Holland-Muter) and the manner in which the matter will be heard (i.e. Microsoft Teams/ in Open Court), and name and details of Counsel/Practitioner and those of the instructing attorney should appear at the end of the draft order.

 

6.         Attorneys for the Applicant should also ensure that a compliance declaration and certificate of urgency are uploaded onto Caselines, failing which the matter will be removed from the roll.

 

7.        Kindly take further note that all the opposing documents should be uploaded onto Caselines by Friday 17 March 2023 before 16h30.

 

8.        In all proceedings, Counsel/Practitioners appearing before the court should be properly robed for the hearing. During virtual proceedings Counsel/Practitioners who are not addressing the court should mute their microphone and switch off their camera.

 

9.        The decorum of the court is to be maintained at all times. Please be advised that it is not protocol to contact a judge personally, either by way of an e-mail or a phone call.

 

10.       Notices of removals should be uploaded onto Caselines and emailed to Ms Msimango on ChMsimango@judiciary.org.za
