DIRECTIVE FOR DEFAULT TRIAL JUDGMENTS

BEFORE PIENAAR AJ (Ms) IN 2023; TERM 1; WEEK 10 (20 TO 24 MARCH 2023)

 

1.        Be advised that there are no matters set down for Monday 20 March 2023.

 

2.       The rolls for Wednesday 22, Thursday 23 and Friday 24 March 2023 appears below this directive.

 

3.        Kindly take note that matters will be dealt with in open court, being court 6A for the whole of the week commencing at 10:00 each day.

 

4.        Removals and postponements should be communicated by e-mail to Mr Ellick van der Merwe at evandermerwe@judiciary.org.za & evandermerwe.judiciary@gmail.com as soon as Counsel/Attorney becomes aware thereof.

 

5.       Proceeding will commence with postponement and removals. Thereafter matters will be heard according to seniority of the Counsel/Attorney appearing in the matter.

 

6.       Counsels are requested to upload the Heads of Argument and the proposed Draft Order (in both PDF and MS Word formats) onto Caselines in a separate created section by 12:00 a court day before the set down.

 

7.      Kindly create a separate section onto Caselines named - Directive Compliance. Therein must appears the following (no hard copies hereof will be accepted during court proceedings):

 

7.1       Compliance Affidavit;

 

7.2        Practice Note;

 

7.3       TIC Order;

 

7.4       Proof of service of TIC Order;

 

7.5       Notice of set down and proof of service.

 

8.        In matters that have become settled: - Please create a section onto Caselines

named Settlement documents, which must include the following (again, no hard copies hereof will be accepted during court proceedings):

 

8.1        Offer from the RAF;

 

8.2        Proposed Draft Order;

 

8.3       Confirmation letter;

 

8.4       Contingency fee agreement (if applicable).

 

9.        Counsels are requested to bring one hard copy of the proposed Draft Order, to hand up to Court.

 

10.      All granted orders will be dated and endorsed, signed and stamped by a Registrar and uploaded on Caselines, within the stipulated timeframe, by Mr Ellick van der Merwe.
