TO:       ALL LEGAL PRACTITIONERS

RE: 14 & 16 MARCH 2023 UNOPPOSED DIRECTIVE BEFORE THE HONOURABLE MADAM JUSTICE PHAHLANE.

 

1.    Kindly note that matters will be heard virtually (Ms Teams) before the Honourable Madam Justice Phahlane on the 14th & 16th March 2023 and ALL Counsel are to appear unless their matters have been disposed of by notice of removal;

 

2.    In the interim and to assist the above-mentioned Judge, please note the following:

 

2.1   To assist the Judge in the deliberation of the matters on her roll and to prevent matters from being struck, parties should ensure compliance with the relevant practice directive pertaining to Unopposed motions.

 

2.2   Draft orders should indicate when the matter will be heard, the Judge’s name (i.e Judge Phahlane) and the manner in which the matter will be heard (i.e Microsoft Teams), and at the end of the draft order the party must indicate the name and details of both counsel/practitioner and that of their instructing attorneys. Practitioners are urged to exclude the last prayer that reads “Further and/or alternative relief” in their draft orders.

 

2.3  All Counsel/ Practitioners who will be appearing on virtual proceedings should be robed.

 

2.4  Counsel/ Practitioners who are not addressing the Court at the time of the hearing should mute themselves and switch off the camera unless permitted otherwise when the matter is being heard. The decorum of the Court is to be maintained at all times.

 

2.5  Matters may be called in order of seniority. Please do ensure that you join the meeting 15 minutes prior to the commencement of the proceedings.

 

2.6  Notices of removals must be transmitted electronically to the secretary at zmsimanga@judiciary.org.za before 12h:00 on the court day preceding the hearing of the application and uploaded on Caselines in a separate section. In which case, Counsel will automatically be excused from appearing if receipt of removal has been confirmed

 

3.    Counsel/Practitioners are to access the link(s) on page 3 below in order to join the meeting. Please ensure you have received same.

 

4.    Links vary for each day
