DIRECTIVE FOR CIVIL TRIAL INTERLOCUTORY APPLICATIONS
20-24 FEBRUARY 2023
1. Kindly take note that matters will be dealt with in open court commencing at 10:00 each day. Please verify the court venue on the day roll.
2. Matters will be called in order of seniority and once counsel is on his/her feet, they may call all matters on the roll in which he/she is appearing.
3. All the papers should have been filed when the Registrar sent the rolls out to the Judge.
4. A draft order in Word format, reflecting the Judge’s surname, the relevant date and the correct case particulars, should be uploaded by 13:00 one court day before the hearing i.e. in matters enrolled for hearing on Monday 20 February 2023 the draft order should be uploaded by Thursday 16 February 2023 at 13:00.
5. Draft orders should contain a disclaimer, indicating the date of hearing, Judge’s names (i.e. Noko AJ), manner of hearing (i.e. Open Court) and the name and details of Counsel/Practitioner and those of the instructing attorney.
DISCLAIMER: This Order is made an Order of Court by the Judge whose name is reflected hereon, duly stamped by the Registrar of the Court and is submitted electronically to the parties or their legal representatives by e-mail. This Order is further uploaded to the electronic file of this matter on Case Lines by the Judge or his/her Secretary/Registrar. The date of this Order is deemed to be FEBRUARY 2023.
6. Please refrain from sending draft orders by e-mail. Draft orders should only be uploaded to CaseLines.
7. Counsel are requested to bring one hard copy of the draft order to hand up to Court.
8. If there is non-compliance with the practice directive, the matter will be struck from the roll, unless good cause is shown for non-compliance.
9. Removals and postponements should be communicated by e-mail to Ms. Hefer at JHefer@judiciary.org.za.
All granted orders will be electronically endorsed on CaseLines and uploaded to CaseLines by Ms. Hefer.
