OPEN COURT HEARINGS: COURT 8F

1.           All parties are to file practice notes by 17:00 on Friday 3 February 2022.

2.           Parties are instructed to have regard to widely shared notes on caselines. The matters will then be dealt with in one of three ways: -

2.1.        Papers are in order: The papers are in order and parties are not required to attend to court and are requested to upload a draft order onto caselines. The Court will indicate, at the latest, on widely shared notes on caselines at 15:00 the day before the matter has been set down whether the papers are in order. In these matters the Court will make an order in chambers and parties are not required to attend to a hearing of the matter.

2.2.        Concerns are raised on widely shared note: The Court raises concerns or queries that parties are required to address. If these can be addressed by directing the Court's attention to a specific part of caselines or alerting the Court to any caselaw, then parties can do so on widely shared notes. Parties are requested to address any queries before 13:00 the day before the set down of the matter. If the queries are sufficiently addressed the Court will indicate the papers are in order before 19:00 the day before the hearing. If not, then parties will be required to attend to court - in terms of paragraph 2.3 of the directive.

2.3.        Matters that require hearing in open court: matters that require a hearing in open Court 8F will commence at 10h00, save for matters on the roll on Tuesday 7 February which will be heard at 14:00 in open court. Parties must bring ONE hard copy of Draft Orders sought. Draft Orders must correctly indicate the Judge’s name (i.e. DE VOS AJ), date on which the matter was heard, in which Court and at the end of the draft order the party must indicate the name and contact details of their counsel and their instructing attorney.

3.            Notices of removals or postponements which occur before 13h00 the day before the matter has been set down and must be emailed to the email address ChMsimango@judiciary.org.za.

4.             To assist the Judge in the deliberation of the matters on her roll and to prevent matters from being struck, parties should ensure compliance with the relevant practice directives.

5.             During the open court hearing the following shall be adhered to:

5.1.              Introductions shall take place in court and not in chambers.

5.2.              Matters will be called in accordance with the order of roll.

5.3.              If a counsel is appearing in more than one matter on the roll, counsel is to call all the matters she/he appears in, in order to finalize counsel’s roll as expeditiously as possible and for counsel to be excused from the court.

5.4.            Matters where there is no appearance will be recalled at the end of the roll, if there is still no one in appearance then it will be struck from the roll.
