  • Legal Practitioners /Litigants are to take note of the allocated time for the hearing of their matters.

  • Non-appearances at the allocated time will result in matters been struck off the Roll, Matters will have to be set down again in the usual manner.

  • Stood down matters will be allocated a time slot after 12h00 by the Judge hearing the matter. Legal Practitioners must leave the court ‘precint’ and return at allocated times after 12h00.

  • Observing of social distancing: It is recommended that Legal Practitioners /Litigants arrive and be in attendance in the designated area outside the court building not later than 15 minutes before the allocated time on the roll. Legal Practitioners /Litigants will be allowed into the court building 5 matters at a time.

  • When Legal Practitioners /Litigants in a matter are finished, he/she will exit the courtroom and immediately exit the building.

NOTICE

 

       Kindly note that there has of recent being a number of    

           applications for default judgment   in terms of Rule 31(2)(a)

           of the Uniform Rules of Court set down on the Motion Court

           Roll.

           Rule 31(2)(a) provides:

 

whenever  in an action the claim or, if there is more than one claim, any of the claims is not for a debt or liquidated demand and a defendant is in default of delivery of a notice of intention to defend or of a plea, the plaintiff may set the action down as provided in subrule (4) for default judgement and the court may, after hearing evidence, grant judgment against the defendant or make such order as it deems fit”

 

In Venter v Nel 1997(4) SA 1014(N) at 1016A it was, for example, pointed out that the practice in the Division is to hear some evidence on the claims for damages but that the inquiry is not as detailed or controversial as it would be were the matter defended.

 

Kindly note that in matters where Rule 31(2)(a) are applicable, dates will not be allocated on the Motion Court Roll. Matters holding such dates are to be removed and referred to Case Flow Management for compliance with Rule 37A and certification, and will thereafter be allocated trial dates.
