On the Committee at the
Constitutional Assembly. We wish to bring to your attention the
following.
Law pertaining to imprisonment of debtors section 65a to 65m
of the Magistrates Courts Acts No. 32 of 1 944 are invalid as they were
inconsistent with Sections 10, 11 and 25 of the Constitution.
Section 7
of the Constitution/refer) the Sections of the Act were invalid in terms of
chapter three (3) of the Constitution.
When are we going to stop being
harrased and thrown in jail for debts. We are treated worse as prisoners.
(criminals).
The salesman harrass our wives to buy goods without checking
period of employment, previous credit record, promises of empty promises.
Can
we help if we are unfairly dismissed, retrenched, can't find work etc etc
etc.
When you pay what you can you are still summons and send threatning
letters. The shops refuse you R50,00 or R75,00 pm. Do they want
you to steal,
rob or kill when you have worries, anxiety and fear.
I can understand why
shops are robbed at times the very shop who send threatning letters of
imprisonment.
I appeal to the Constitutional Court to sit on this matter
with urgency. We are not slaves or dogs we are human. We have feelings
when we
receive threatning letters. I appeal to Mr Cyril Ramapohsa to look into this
matter which I'm sure he will.
He is the man who can steer this
Constitutional Assembly because he knows our suffering and plight.
