As a Registered Voter I Would Like To [1995] ZAConAsmRes 891 (20 February 1995)

20/2/1995

As a registered voter I would like to "have my say in the drawing up of the Constitution".

I firmly believe in the retention and carrying out of the death sentence. The death sentence should be imposed for murder, robbery with violence, particularly where weapons are used and victims are injured or killed, in other words armed robbery, armed rape, particularly if the perpetrator is found to be HIV positive as he has as good as murdered his rape victim. All cases of violent abuse and, in particular, rape of young children. The perfect case for the death sentence and the carrying out thereof, is the little girl from Gauteng who has been violently abused by her own parents but also by a couple supposedly taking care of her. All four of these persons thoroughly deserve the death sentence. I also believe a time limit, e.g. 1 year from date of sentencing, the death sentence should be carried out.

I trust that I misheard that thought is being given to releasing all those sitting on death row at the moment. That is ludicrous, I also do not believe there is such a thing as a political murder, only racist murders. For example, Amy Biel was murdered because she was a white girl in a non-white area and the perpetrators should definitely receive the death sentence.

Another matter I would like considered is in the case of divorced women who receive a property settlement in the divorce. At the moment the woman has to pay a transfer fee to transfer the property into her name. I believe this matter has been raised before by the legal fraternity and I think something should now be done to have this fee dropped and the transfer automatically made over to the women.

I would like to take this opportunity to wish you all success with the drawing up of the final Constitution which is obviously a monumental job. May God guide you with much wisdom.
