Citizen Contribution: A Rani [1995] ZAConAsmRes 593 (2 February 1995)

2 February 95

I have read that, according to the law, in order to be eligible for compensation, one must prove financial loss i.e. that the person who claim the loss may be dependent to the deceased otherwise he/she got not claim to the third part who might have caused the death of the deceased e.g. Since one is not dependent on a child under age of five there is no financial loss.

I therefore propose that, that law may be changed/repealed in its entirety become

it is unfair.

I say this because, the parents of the child or the like, have suffered a lot in causing the child to grow, orland even the mother has suffered pain during birth and even during pregnancy.

I think the feeling of the child's parents may be considered in all respects.

I am talking of the death caused by the third party negligently or the like. I even

insist that the child of one day, its parents may be compensated.

Yours faithfully
