WILLIS, J: This is an application for leave to appeal against the judgment which my learned brother De Jager AJ and I gave in this matter on appeal on 25 September 2002.

In my view there is no reasonable prospect that another court will come to a different conclusion and accordingly, in my view, there are no reasonable prospects of success on appeal. I propose that the following order be made: The application for leave to appeal is dismissed with costs.
