The foIIowing Act which has been passed by the Parliament and signed by the President in terms of the Namibian Constitution is hereby published in terms of Article 56 of that Constitution. No. 17 of 1997: Regional Councils Amendment Act, 1997.

ACT
To amend the Regional Councils Act, 1992, so as to provide for the appointment of the delimitation commission at intervals of not less than five years; to define the powers, duties and functions of the chairperson; to empower a management committee to, in the absence of its chairperson, elect any of its members to preside at a meeting; and to provide for incidental matters. (Signed by the President on 19 December 1997) BE IT ENACTED by the Parliament of the Republic of Namibia as fol-

lows: Amendment of section 5 of Act 22 of 1992
1. Section 5 of the Regional Councils Act, 1992 (hereafter referred to

as the principal Act), is amended by the substitution for paragraph (b) of subsection (1) of the following paragraph: "(b) shall at intervals of not less than [six] five years and not more than 12 years, commencing from the commencement of this Act, with a view to re-dividing the regions into constituencies, ". Insertion of section 18A in Act 22 of 1992

The following section is inserted in the principal Act after section 18 : "Powers, duties and functions of chairperson (19A) A chair erson referred to in subsection (1) of

be the political head and, in consultation with the regional council concerned (i) initiate and formulate planning and development policies; and (ii) closely monitor the implementation of the

policies contemplated in subparagraph (i); (b) have supervisory powers regarding the planning an execution projects;

Amendment

of section 21 of Act 22 of 1992

Section 21 of the principal Act is amended by the insertion of the

following subsection after subsection (2) : "(2A If the chair erson is absent from a meetin of the

management committee, the members present at such meeting shall from their number elect a person to preside at such meeting and such person so elected shall, while he or she so presides, exercise all the powers and perform all the duties and functions of the chairperson." .
