""'" 27 Government Notices MINISTRY OF FISHERIES & MARINE RESOURCES No. 196 1996 ANNOUNCEMENT OF PERIOD DURING WHICH APPLICATIONS FOR RIGHTS OF EXPLOITATION UNDER THE SEA FISHERIES ACT, 1992 MAY BE MADE Under section 14(2) of the Sea Fisheries Act, 1992 (Act 29 of 1992) I hereby announce that applications for rights of exploitation for deep water fisheries may be made during the period 1 September 1996 to 30 September 1996, subject to the conditions and criteria set out in the Schedule below. No. 1369 Government Gazette 1Au SCHEDULE 1. st 1996 3 The granting of the right of exploitation shall be subject to the conditions imposed by the Minister under section 14(4) of the Sea Fisheries Act, 1992. The matters to which the Minister may have regard when considering an application for a right of exploitation are (a) in terms of section 14(6) of the Sea Fisheries Act, 1992:"(a) (b) whether or not the applicant is a Namibian citizen; where the applicant is a company, whether the beneficial control of the company is vested in Namibia citizens; the beneficial ownership of any vessel which will be used by the applicant; the ability of the applicant to exercise the right of exploitation in a satisfactory manner;"; and 2. (c) (d) (b) in terms of regulation 2 of the Sea Fisheries Regulations promulgated under Government Notice No 1 of 1993 :"(a) the advancement of cially, economically criminatory laws or practised before the persons in Namibia who have been soor educationally disadvantaged by dispractices which have been enacted or independence of Namibia; (b) (c) regional development within Namibia; co-operation with other countries, especially those in the Southern African Development Community; the conservation and economic development of marine resources." r 3. (d) A right of exploitation under this notice shall be granted for a term of 4 or 7 or 10 years as from 1 January 1997 in accordance with the policy statement referred to in paragraph 12 below. Applicants are advised that the deep water fishery targeting for orange TOughy and alfonsino is still at an early stage of its development and a maximum of three rights will be granted as a result of this invitation. In this respect (a) the future level of total allowable catches in this fishery is uncertain. In announcing applications for rights for this fishery no commitment is implied that the fishery will provide viable sustainable levels of quotas, and no liability in this respect will be accepted by the Government; and 4. . '" 4 (b) Government Gazette 1Au st 1996 No. 1369 the primary objectives of the Government in managing these resources at this stage are the exploration of new fishing grounds and the generation of scientific information on the resources. When assessing the ability of applicants to exercise the right of exploitation in a satisfactory manner referred to in paragraph 2(a) above, a high priority will be attached to the ability of applicants to meet these objectives. 5. The holder of a right of exploitation shall be required to implement biological sampling and other research programmes. The Minister may impose a quota fee if and when deemed necessary. The target species in the deepwater fisheries shall be orange roughy and alfonsino. All catches of orange roughy shall be processed on shore. There will be a limitation on the numoer of vessels to be utilized. All vessels utilized must be Namibian registered and be equipped with satellite data systems as prescribed by the Ministry. Applications already in possession of the Ministry will not be considered and all prospective applicants for rights of exploitation must apply anew. The necessary application forms for rights of exploitation and a policy statement on the granting of such rights to utilize marine resources are obtainable on written request from the Permanent Secretary, Ministry of Fisheries and Marine Resources, Private Bag 13355, Windhoek, or on personal request at the Head Office of the Ministry of Fisheries and Marine Resources in Windhoek. Applications on the prescribed forms, together with all written information in support thereof, shall be submitted at the above address in a sealed enve lope addressed to the Permanent Secretary and with the name of the appli cant and the right being applied for, clearly marked on the envelope. The deadline for receipt of applications is five o'clock (17hOO) on Monday, 30 September 1996. All applications will be kept unopened in safe custody until the closing date for applications. Where an application is received unsealed, it will be placed in a sealed envelope marked with the name of the applicant.
