Nkambule Nelson v Rex (14/1997) [1997] SZCA 6 (22 September 1997)
IN THE COURT OF APPEAL OF SWAZILAND
CASE NO. 14/1997
In the matter between:
Nelson Nkambule
Appellant
vs
Rex
Respondent
Coram
Kotze, JP
Tebbutt, JA
Browde, JA
For Appellant
In person
For Crown
Mr. D. Wachira
JUDGMENT
22/9/97)
KOTZE, JP
The appellant was found guilty of culpable homicide by the trial judge. It true that the appellant committed a very severe assault
upon the deceased person who was his wife and a sentence of 7 years imprisonment was imposed . This is undoubtedly a heavy sentence
but in my view it is not an unreasonable one. The deceased died as a result of a vicious assault committed by the appellant and there
is no basis upon which we can find that there was an improper exercise of discretion by the trial judge.
It follows that the appeal is dismissed.
