In this notice, a word or expre~sion to which a meaning has been given in the Act has that"meaning, and unless the coptext otherwise indicates "agent" means any person to whom the A~ministration has, under section 15(3)(b) of the Act, delegated its power to collect e*ry fees and includes an employee of the Administration who performs the same fun~tion; I I ! "the Act" means the Road Fund Administr4tion i , , i Act, 1999 (Act No. 18 of 1999); "entry fee" means the fee payable under pa/ragraph 2; "entry fee certificate" means the certificatei issued under paragraph 3(4); 1 I "foreign vehicle" means a motor vehicle which is not registered under the Road Traffic Ordinance, 1967 (Ordinance No. 30 of 19 7); and (.) "operator" means the person who brings a motor vehicle at any entry point to Namibia for the purpose of bringing that motor veh cle into Namibia. Rate of entry fee 2. The entry fees payable to the are set out in the Annexure. Payment of entry fee ministration by operators offoreign vehicles 3. (1) The entry fee is paya le to the Administration on or before each occasion that a foreign vehicle enters Na ibia. (2) On entering Namibia, t e operator of a foreign vehicle shall complete a written application in the form determi d by the Administration and that form shall contain particulars of the vehicle, the ower of the vehicle and any other information which is relevant to the application. c (3) An operator who has c mpleted an application form as contemplated in subparagraph (2) shall submit to an age t(a) the completed applica on form together with (i) (ii) (iii) - the registration ertificate relating to the vehicle or a certified copy of the sam; a police clearan e certificate issued in the country where the vehicle is regist red or a certified copy of the same; or some other doc mentation which contains information on the engine number, hassis number, the registration number of the . vehicle in ques on, if available, and particulars of the owner of the vehicle 0 certified copies of that documentation; and - (b) the appropriate entry ee. (4) On receipt of the entry fee and documents referred to in subparagraph (3), an agent shall, ifhe or she is satisfied hat the application is in order, issue out to the operator of the relevant foreign vehicle, entry free certificate relating to that vehicle. (5) An operator to whom n entry certificate has been issued shall, when departing from Namibia, submit the certi lcate to an agent at the point of departure from Namibia. 4 Government Gazette 21 November 2000 No. 2438 (6) On receipt of an entry fee ertificate as contemplated in subparagraph (5), the agent shall cancel the certificate. Exemption 4. A foreign vehicle which is ente ng Namibia whilst being carried in or on another motor vehicle is exempt from the req irements of this notice. Refund of entry fee 5. (3) Notwithstanding subparagraph (1 the Administration shall, from the refund referred to in that subparagraph, deduct the a ount of administrative costs as set out in the Annexure. Offences and penalties 6. (1) (a) (b) Subject to paragraph 4, no erson shallbring a foreign vehicle into Namibia; or drive a foreign vehicle on y road in Namibia, fee certificate issued in respect of that unless that person is in possession of an ent foreign vehicle. (2) A person referred to in subparagr h (1) shall, whilst in Namibia, keep the relevant entry fee certificate in the foreign vehi Ie in respect to which it was issued and shall, on being requested, produce that certific te to an authorised officer referred to in the Road Traffic Ordinance, 1967 (Ordinance o. 30 of 1967). (3) A person who contravenes sub aragraph (1) or fails to comply with subparagraph (2) commits an offence and is lia Ie on conviction to a fine not exceeding N$2 000 or to be imprisoned for a period not e ceeding 1 year. (4) Subject to a paragraph 4, no age shall allow a foreign vehicle to enter Namibia unless the operator of that vehicle is n possession of an entry fee certificate issued in respect of that vehicle.
