The subarticle does not distinguish between international or municipal acts done under laws prior to independence or prior to the
creation of the State of Namibia. This view accords with the thinking of the International Law Commission when it considered the
status of National Liberation Movements. Article 15, paragraph 1 of the draft articles on State responsibility, adopted by the International
Law Commission attributes to the State which has a new government after the insurrection, not only the acts of the organs of the
